The following requirements must be met in order to validate European patents in Cambodia:
- The European patent must have a filing date that falls on or after 1 March 2018. Validation is not available for patents filed prior to 1 March 2018;
- The European patent must align with the Law on Patents in force in Cambodia, an example of which pharmaceutical products are excluded from patent protection until the Agreement on Trade-Related Aspects of IP Rights (TRIPS) have expired; and
- The claims of the European patents must be translated into the Khmer Language.
A validation fee of EUR180 must be paid to the EPO within six (6) months from publication of the European Search Report provided by the EPO. After the expiry of the above basic time limit, the validation fee can still be paid within a two months grace period in which a surcharge of 50% is paid on top of the validation fee. If the validation fee is not paid within the period, the request for validation will be deemed withdrawn. Within three months of the grant by EPO, the applicant will then need to submit a request to validate the European patent as a Cambodian national patent with the Ministry of Industry and Handicraft.
[:ja]欧州特許庁とカンボジア工業手工芸省は、欧州特許のカンボジアにおける有効化手続きについて協議を進めておりましたが、2017年1月23日に署名を行い、2018年3月1日より協定発効となりました。これにより、カンボジアはアジアで初めて欧州特許の認証国となり、欧州特許条約の締約国への仲間入りを果たしました。
2018年3月1日以降に欧州出願を行う者は、カンボジアを認証国として指定することができ、欧州特許庁により特許付与された発明をカンボジアでも保護することが可能となります。カンボジア特許庁としては、従来の国内出願に比べて特許審査にかかる時間を短縮化し、出願人の金銭的負担を軽減し、庁内における審査業務の円滑化できることを理由として、今回の合意に踏み切りました。
欧州特許をカンボジアで有効化するための要件は、以下の通りです。
- 欧州特許の出願日が2018年3月1日以降であること（出願日がこれより前のものについては、いずれも有効化の対象となりません）。
- 医薬品の特許でないこと（カンボジアではTRIPS協定を適用するまでの経過期間として、医薬品関連の特許保護が免除されています）。
- 特許請求の範囲のクメール語翻訳を提出すること。
カンボジアを認証国として指定するための費用は「180ユーロ」です。これを欧州特許公報において欧州サーチレポートの公開について言及する日付より六月以内に納付する必要があります。かかる期限日までに料金納付ができなかった場合でも、当該期限日より二月のグレースピリオド期間内であれば、50％の割増料金を支払うことにより適法な有効化手続きとして認められます。もし料金納付が期限内に行われなければ、カンボジア認証の請求は取下げられたものとみなされます。
なお、上記手続きを進めるに際しては、欧州特許公報の発行日から三月以内にカンボジアを指定しなければなりません。
